Arrest of Gurugram-based CAs in tax fraud case triggers protests

GURUGRAM: The arrest of two Gurugram-based CAs for an alleged Rs 15 crore-fraud has triggered a series of protests led by the Institution of Chartered Accountants of India (ICAI) against officials of the CGST office in the city.
ICAI members, who protested at the CGST office in Sector 32, have alleged that the two CAs were being made scapegoats in the case. They also demanded a CBI inquiry against the tax officials allegedly connected to the fraud.
The case is related to claims of input credit tax (ICT), allegedly made by fake companies. ICT is the tax that has already been paid at the time that the good or service was purchased. The amount is deducted from total payable tax and refunded.
The two chartered accountants — Sunil Mahalawat and Gaurav Dhir — have been accused of issuing audited account statements of fake companies through which ICT was claimed. These statements, or certificates, are necessary to claim input credit tax.
The two CAs were called in for questioning by the CGST office on Wednesday. According to ICAI, there were allegedly harassed and kept at the office through Thursday. Based on a complaint by CGST officials, police arrested them on Friday and produced them in a court. ICAI protesters, who demonstrated at the CGST office on Friday, said they too were harassed and illegally detained at the office. The protesters also included the CAs’ family members who are part of ICAI.
Pradeep Yadav, an ICAI member, said they also filed a police complaint against CGST officials for wrongful restraint and demanded registration of an FIR against them. A senior police officer said it did not appear to be a case of wrongful restraint.
The two CAs have been booked for cheating and fraud on the basis of the complaint filed at the Sector 40 police station in the city. They are currently in police custody.
“The CGST officials who approved the input credit tax and the person who received the amount are out but action has been taken against the CAs for issuing the certificates,” Yadav said.
He added: “A refund of this magnitude can only be approved by senior GST officials. It has also been alleged that GST officials are taking commissions to approve these bogus tax claims. Normally it takes months to approve a claim, but in this case, the refund was approved within hours.” CGST officials did not respond to requests for comment.
