Gurgaon: The developer of Sushant Lok-1 has allegedly felled five peepal trees in a park spread across 1.25 acres in the C block of the colony near Gold Souk without taking permission. Residents have filed a complaint with the Haryana forest department, demanding action against the developer.
According to the forest department, it gave its nod for felling five ashoka trees and the transplantation of three Peepal trees and two banyan trees on May 2. However, it later suspended the same after residents informed the department about a Supreme Court stay order on tree felling in Sushant Lok 1, which also directed the developer to maintain the status quo.
“Yes, we had given permission for the transplantation of five trees and the felling of five ashoka trees but later suspended it. So, there was no permission for tree felling,” said Rajeev Tajyan, divisional forest officer, Gurgaon. He added that the department would investigate the matter.
“The park is specifically covered in the stay order issued by the Supreme Court on tree felling in Sushant Lok 1. Any change in the status and state of this park is then contempt of the SC. Earlier, we had submitted a complaint to the forest department, and it suspended its permission for tree felling in the park. However, the developer still uprooted the trees,” said Dr Susan Sharma, a resident of Sushant Lok 1.
Yatish Kumar Goel, a lawyer for the residents, said, “The developer did not have any permission to fell trees in the area. Also, there is an SC order to maintain the status quo. We will approach the SC to take action against the violators.”
However, the developer told TOI that it had permission from the forest department to cut the trees, and the land is not in any legal tangle.
“We have got permission for tree felling and transplantation. We did not receive any notice about the suspension of permission. We have not violated any laws. The land, referred to as a park, is a designated site for a dispensary. Some residents use it as open space. They had approached the lower and session courts, but it did not yield any fruitful results. There is no case in the Supreme Court related to this particular land,” said Arun Kumar Arora, director, Trueworth Developers.
