Haryana: Man gets 20 years in jail for raping stepdaughter in 2018

GURUGRAM: A fast-track POCSO court in Panipat on Monday sentenced a man to 20 years of rigorous imprisonment for raping his eight-year-old stepdaughter under the influence of alcohol in 2018.
Additional sessions judge Sumit Garg handed down the punishment to the man (in his early 40s) after holding him guilty of aggravated penetrative sexual assault under the POCSO (Protection of Children from Sexual Offences) Act and rape under the IPC. The court also ordered the convict to pay a compensation of Rs 75,000 to the girl. “The convict has breached the trust of a daughter in her father. Though, the victim was the step-daughter of the convict, the nature of the trust would remain the same. The offence of rape committed by the convict has thus become graver and has accordingly been placed on a graver footing in the penal code as well,” the judge observed in his order.
The case was reported at the Women’s police station in Panipat on the night of August 14, 2018. The horrific crime occured that evening only when the girl, who was with her mother outside their makeshift home at a construction site, went inside to drink water. Her step-father who was already there caught hold of her and raped her under the influence of alcohol, according to the prosecution.
The girl had initially tried to resist the crime, but was overpowered by the man. And when she started crying, the man whiffed out a knife and threatened to kill her if she narrated her ordeal to someone. “Finally when her father fell asleep, she narrated the crime to her mother. Wasting no time, the woman alerted the cops. A police team soon took her father into custody,” said Panipat district attorney Rajesh Choudhary.
Based on her mother’s complaint, a case was registered under Section 6 (aggravated penetrative sexual assault) of the POCSO Act and sections 376AB (rape of girl under 12 years of age) and 376(2) (rape by known person) of IPC. Later the girl recorded her statement before a magistrate under Section 164 of CrPC, which authorises a judicial officer to record the confession or version of a person.
“The court pronounced the judgment mainly relied on the girl’s version during the trial, though it said that the testimony of the mother would also be relevant under Section 6 of the Evidence Act,” Choudhary said.
